Title: SETTLEMENT RESOLUTION - $3,321,809.25 – ARISING OUT OF A PETROLEUM SPILL WHICH OCCURRED N OR ABOUT JUNE 6, 1989 PURSUANT TO ARTICLE 12 OF THE NEW YORK NAVIGATION LAW. (FISCAL IMPACT – AMOUNT OF SETTLEMENT.) (ALL COUNCILMEMBERS.)

RESOLUTION

 

BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER  RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS, PINEDA-ISAAC, DIAZ AND HODGES:

 

RESOLVED, by the City Council of the City of Yonkers, in meeting

 

 assembled:

That the settlement by the Corporation Counsel of the matter, State of New York v. City of Yonkers, Index Number 66416/2025 (Sup. Ct. Westchester), regarding the New York State Spill Number 89-02346 arising out of a petroleum spill which occurred on or about June 6, 1989; pursuant to Article 12 of the New York Navigation Law, the State is authorized to recover from a responsible party, and the insurer thereof, all cleanup and removal costs, interest thereon, and applicable penalties, associated with the Discharge; the New York Environmental Protection and Spill Compensation Fund (the “Fund”), has expended cleanup and removal costs in the amount of $3,321,809.25; which matter has now been settled with the City in the full amount of THREE MILLION, THREE HUNDRED TWENTY-ONE THOUSAND, EIGHT HUNDRED NINE AND 25/100 ($3,321,809.25); be and hereby is approved; and by authorizing the Mayor to enter into a Settlement Agreement that ensures the schedule of payment of said funds; and be it further

                     

RESOLVED, that this resolution shall take effect immediately.
