BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS PINEDA-ISAAC, DIAZ, AND MERANTE:

A RESOLUTION ISSUING A HOME RULE MESSAGE FOR SENATE BILL S8271 AND ASSEMBLY BILL A8677 IN RELATION TO THE UNTERMEYER PARK LAND SWAP

WHEREAS, Senate Bill S8271 and Assembly Bill A8677 have been introduced by the New York State Legislature for the purposes to authorize the City of Yonkers to alienate a portion of Untermyer Park and to give this portion of land to St. John's Riverside Hospital in exchange for an adjacent portion of land
owned by St. John's Riverside Hospital; and
WHEREAS, a home rule message is required in order to pass these bills, which will then allow the City to take the necessary steps in order for the improvements to be made; and
WHEREAS, the City Council has already considered and adopted Resolution No. 65-2025 requesting that this legislation be introduced; and
WHEREAS, the City Council sought Lead Agency for the Project pursuant to the State Environmental Quality Review Act ("SEQRA") (Reso 64-2025), and its implementing regulations, 6 NYCRR Part 617;
WHEREAS, the City Council has carefully considered the proposed action, has reviewed the attached Environmental Assessment Form ("EAF"), supplemental attachments, and the criteria set forth in Section 617.7 of 6 NYCRR Part 617 of the SEQRA, and has identified and carefully considered the relevant areas of environmental concern, which are fully set forth in the EAF, to determine if this proposed action will have a significant impact upon the environment.
NOW, THEREFORE, BE IT RESOLVED, based upon the City Council's review of the EAF and for the reasons set forth therein, the City Council hereby adopts a Negative Declaration under SEQRA that there will be no adverse impact on the environment from the alienation and parkland swap;
