Be it enacted by the City Council of the City of Yonkers, as follows:
Section 1. General City Law Section 23 and Second Class Cities Law
Section 37 are hereby superseded to the extent herein, provided as follows:
The City of Yonkers (the "City") owns the property located at 101 Woodland Avenue, Yonkers, New York and designated on the Official Tax Map of the City as Section 2, Block 2421, Lot 24.25 (the "Premises"). The Premises is not currently being used, nor has it been designated for specific use in the future, nor can it be utilized by the City of Yonkers for its intended municipal purpose and is thereby considered surplus.
103 Woodland LLC, a New York limited liability company (the "Abutter"), owns a property that abuts the Premises known as 103 Woodland Avenue, Yonkers, New York and designated on the Official Tax Map of the City as Section 2, Block 2421, Lot 23. The Abutter has expressed an interest to the City in purchasing and developing the Premises.
The City Council of the City (the "City Council") hereby authorizes the Mayor to execute a contract of sale containing substantially the same terms and conditions as set forth below with the Abutter or an affiliate entity for the sale and development of the Premises. The terms and conditions as set forth below are hereby approved by the City Council, as the redevelopment of this property as stated hereinabove would be in the best interest of the City.
Section 2. The contract of sale of the Premises shall contain terms and conditions substantially similar to the following:
(1) consideration for the sale will be one hundred fifteen thousand dollars ($115,000.00), which is the fair market value of the Premises per an appraisal ordered by the City and performed by a dul...
