RESOLUTION TO APPROVE AN AMENDMENT TO THE PLANNED URBAN REDEVELOPMENT SPECIAL USE PERMIT ON PROPERTIES KNOWN AS 40 AND 2 RIVERSIDE DRIVE, 300 ADMIRAL WAY, 85, 75, 71, 65, 55, 45, 35 AND 25 RIVERSIDE DRIVE, 100 FISHERMAN WAY, 100 ADMIRAL WAY, ALSO KNOWN AS SECTION 2, BLOCK 2620 LOTS 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 AND 13, PURSUANT TO ARTICLE VII OF THE YONKERS ZONING CODE.

WHEREAS, in March 2017, the City Council of the City of Yonkers (the “City Council”), following Planning Board approval, approved a special use permit for the development of a Planned Urban Redevelopment (“PUR”) on the property located at 40 and 2 Riverside Drive, 300 Admiral Way, 85, 75, 71, 65, 55, 45, 35 and 25 Riverside Drive, 100 Fisherman Way, 100 Admiral Way (Block 2620, Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10,11, 12 and 13 (the “Property”), which permitted the development of a total of 1,395 residential dwelling units in seven (7) buildings (Buildings A, B, C, D, E, F and Tower) together with approximately 48,280 square feet of commercial space, approximately 1,598 parking spaces, and a number of public amenities including a public waterfront promenade and public open space (the “Project”); and

WHEREAS, in April and May 2024, the Planning Board and City Council, respectively, approved an amendment to the previously approved PUR special use permit in connection with the Project consisting of the inclusion of 59 Babcock Place (Block 2620, Lot 82) as part of the PUR for the purpose of constructing 417 at-grade parking spaces to serve the Project; and

WHEREAS, in March 2026, Extell Hudson Waterfront, LLC (“Applicant”) filed an application for an amendment to the special use permit, seeking to:

a) eliminate the 20-story Tower;

b) construct a parking structure of approximately 543 spaces;
