RESOLVED, by the City Council of The City of Yonkers, in meeting assembled:
That the settlement by the Corporation Counsel in the amount of ONE MILLION THREE HUNDRED AND FIFTY THOUSAND DOLLARS and 00/100 ($1,350,000.00) in the matter entitled “JAMAR SMYTHE, Plaintiff v. CITY OF YONKERS, et al, Defendants,” for injuries arising out of the arrest of the plaintiff on September 16, 2011 and subsequent criminal prosecution, be and the same hereby is approved, and the Comptroller of The City of Yonkers is directed to draw his warrant(s) in the total amount of ONE MILLION THREE HUNDRED AND FIFTY THOUSAND DOLLARS and 00/100 ($1,350,000.00) in favor of “Law Offices of Anthony DiPietro, P.C., on behalf of Jamar Smythe” to be paid in two unequal installments as follows: First payment to be made in the amount of THREE HUNDRED AND FIFTY THOUSAND DOLLARS and 00/100 ($350,000.00) on or before January 31, 2025; and the final payment to be made in the amount of ONE MILLION DOLLARS and 00/100 ($1,000,000.00) on or before June 1, 2025.
