LOCAL LAW AUTHORIZING THE SALE OF 566 SAW MILL RIVER ROAD

Be it enacted by the City Council of the City of Yonkers as follows:
Section 1. New York General City Law section 23 and New York Second Class Cities Law section 37 are hereby superseded to the extent herein, provided as follows:
The City of Yonkers (the “City”) was granted a judgment authorizing the City to take ownership of and/or owns the property located within the City known as 566 Saw Mill River Road and designated on the Official Tax Map of the City as Section 2, Block 2379, Lot 67 (the “Property”).
The Property is not being used by the City currently, has not been designated for specific future use by the City, and cannot be utilized by the City for its intended municipal purpose; therefore, the Property is deemed surplus municipal property.
550 Saw Mill River Road Partners LLC (the “Abutter”) owns the property abutting the Property known as 564 Saw Mill River Road and designated on the Official Tax Map of the City as Section 2, Block 2379, Lot 66 as well as adjacent properties known at 550 Saw Mill River Road and 544 Saw Mill River Road and designated on the Official Tax Map of the City as Section 2, Block 2379, Lots 59.65 and 56, respectively (collectively, the “Abutting Property”). The Abutting Property is currently improved with and operates as a plumbing supply store. The Abutter has expressed its interest in acquiring the Property to the City.
The City Council of the City of Yonkers (the “City Council”) hereby authorizes the Mayor to execute a contract of sale with the Abutter, or an affiliate thereof, for the conveyance of the Property containing terms and conditions substantially similar to those set forth herein as the sale of the Property on such terms and conditions would be in the best interest of the City.
Section 2. The contract of sale for the Property shall contain terms and conditions substantially similar to the following:
(1) the consideration received in exchange for the conveyance of the Property shall be two hundred forty thousand dollars ($240,000.00), which is the fair market value of the Property as determined by an appraisal conducted by a duly licensed appraiser; and
(2) the Property shall be conveyed as is;
(3) the Property shall be used and/or improved in accordance with all applicable local, state, and federal laws, rules, regulations and codes, including the Yonkers City Code;
(4) the Abutter shall be required to pay all applicable City and State transfer tax; and
(5) the Mayor or his authorized designee shall negotiate such other terms and conditions determined to be in the best interest of the City.
Section 3. This local law shall take effect as provided by law.
