RESOLUTION
BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS, PINEDA-ISAAC, DIAZ AND HODGES:
RESOLUTION APPROVING AN INTER-MUNICIPAL AGREEMENT BY AND BETWEEN THE CITY OF YONKERS AND THE NEW YORK CITY DEPARTMENT OF ENVIRONMENTAL PROTECTION REGARDING ANNUAL HAZMAT DRILLS, TRAINING AND OTHER REQUIRED EMERGENCY RESPONSE ACTIVITIES AT THE HILLVIEW RESERVOIR AND OTHER APPROVED LOCATIONS

WHEREAS, the New York City Department Of Environmental Protection (“DEP”) operates and maintains the New York City water supply system and is responsible for providing drinking water to more than eight million residents in the City, as well as approximately one million upstate residents, including users who rely on a water supply from connections to the City’s Delaware Aqueduct, including the residents in Yonkers; and
WHEREAS, DEP’s maintenance and operation of the New York City Water Supply System and its associated facilities, including Hillview Reservoir and other water treatment facilities located throughout Westchester County, involves the storage, use and processing of highly hazardous chemicals; and
WHEREAS, The Yonkers Fire Department (“YFD”) is accredited by New York State Homeland Security and Emergency Services as a Type 1 Hazardous Materials Team, representing the highest level of capability for management of and emergency response to complex hazardous materials incidents; and
WHEREAS, DEP’s storage, use and processing of highly hazardous chemicals requires robust safety and emergency response planning, coordination, training and exercises in collaboration with local emergency responders, including Yonkers YFD; and
WHEREAS, YFD has requested certain funding from DEP and New York City to cover the operational and personnel costs associated with conducting emergency response trainings, as well as the costs of future coordination, planning, training and exercises that YFD participates in at other DEP-approved facilities in Westchester County; and
WHEREAS, the New York City has agreed to provide said funding to the YFD pursuant to an intermunicipal agreement, and
WHEREAS, New York State General Municipal Law Article 5-G, Section 119-o, authorizes municipal corporations and districts to enter into agreements for the performance of various functions.
NOW, THEREFORE, BE IT RESOLVED, that the City be and hereby is authorized to enter into an IMA with New York City and the DEP to recover costs associated with the coordination, planning and exercises that OD participates in at the Hillview Reservoir and other DEP facilities in Westchester County the ; and be it further
RESOLVED, that pursuant to the IMA New York City and or DEP shall pay the City of Yonkers up to an amount not to exceed $875,000 over a term of 5 years, which may be renewed upon mutual consent ; and be it further
RESOLVED, that the City shall pay a fee to the County, which will be responsible for transporting the organic yard waste from the City’s organic yard transfer site to a composting facility;
RESOLVED, that the above constitutes a “Type II” action under the State Environmental Quality Review Act (“SEQRA”), and its implementing regulations, 6 NYCRR Part 617, which is an action determined not to have a significant effect on the environment and therefore does not require further environment review; and be it further
RESOLVED, that Mayor or his authorized designee is hereby empowered to execute all instruments and take all actions reasonable and necessary to effectuate the purposes hereof; and be it further
RESOLVED, that this resolution will take effect immediately.
