RESOLUTION APPROVING AN INTER-MUNICIPAL AGREEMENT BETWEEN THE CITY OF YONKERS AND THE YONKERS INDUSTRIAL DEVELOPMENT AGENCY FOR THE PROVISION OF EMPLOYMENT RELATED ASSISTANCE

WHEREAS, the Yonkers Industrial Development Agency (“YIDA”) a public authority which operates for the benefit of the City of Yonkers, and which incorporates the Workforce Development Board (“WIB”), is in need of human resources support; and
WHEREAS, YIDA is also in need of legal support relating to employment issues, including not limited to general employment law support and disciplinary matters; and
WHEREAS, the City’s Departments of Human Resources and Law are capable of providing such support to YIDA as the state and federal laws governing the City and YIDA, as well as the labor issues and employment issues that may arise, are similar; and
WHEREAS, utilizing existing City resources to assist the YIDA is a cost effective way for the YIDA to perform its human resources function; and
WHEREAS, the parties wish to enter into an intermunicipal agreement (“IMA”) whereby the City’s Departments of Human Resources and Law will provide assistance to YIDA; and
WHEREAS, New York State General Municipal Law Article 5-G, Section 119-o, authorizes municipal corporations and districts to enter into agreements for the performance of various functions; and
WHEREAS, the above referenced IMA constitutes a “Type II” action under the State Environmental Quality Review Act (“SEQRA”), and its implementing regulations, 6 NYCRR Part 617, which is an action determined not to have a significant effect on the environment and therefore does not require further environmental review.
NOW, THEREFORE, BE IT RESOLVED, that the Intermunicipal Agreement between the City of Yonkers and YIDA is hereby approved; and be it further
RESOLVED, that YIDA shall pay the City $10,000 annually during the term of the IMA; and
RESOLVED, that this resolution will take effect immediately.
