RESOLUTION APPROVING AMENDMENT OF THAT CERTAIN INTER-MUNICIPAL AGREEMENT BETWEEN THE CITY OF YONKERS AND THE COUNTY OF WESTCHESTER RELATED TO THE JFK MARINA TO INCLUDE THE FUNDING OF CERTAIN IMPROVEMENTS TO THE HUDSON RIVER MUSEUM.

WHEREAS, on or about December 16, 2008, the County and the Municipality entered into an Inter-Municipal agreement (“IMA”) whereby the County agreed to, inter alia, provide funding to the City for the design of an amphitheater, parking structure, and improvements to JFK Memorial Drive; and

 

WHEREAS, the City and the County duly executed a first amendment on April 12, 2011; and

 

WHEREAS, the City and the County duly executed a second amendment on October 23, 2019 which removed certain road and parking improvements and added improvements to the Museum’s West Wing and Glenview Historic Home (“Museum Projects”); and

 

WHEREAS, the County now wishes to further amend the IMA to amend the IMA from $12,283,000 to $14,202,276.87; and

 

WHEREAS, the County will provide the City with an additional $227,925; and

 

WHEREAS, the Engineering Department has already budgeted additional funds in the Capital Budget; and

 

WHEREAS, New York State General Municipal Law Article 5-G, Section 119-o, authorizes municipal corporations and districts to enter into agreements for the performance of various functions; and

 

NOW, THEREFORE, BE IT RESOLVED, that the City is authorized to enter into an IMA with the County of Westchester to enter into a third amendment of the JFK Marina IMA between the County of Westchester and the City of Yonkers in order to amend the total amount of the Project and increase the amount of funding from the County; and be it further,

 

RESOLVED, that a review pursuant to the State Environmental Quality Review Act (“SEQRA”) and its implementing regulations, 6 NYCRR Part 617, was conducted as required by the original IMA, and the above change in scope and a negative declaration was issued thereto by Resolution No. 125-2018; and be it further

 

RESOLVED, that Mayor or his authorized designee is hereby empowered to execute all instruments and take all actions reasonable and necessary to effectuate the purposes hereof; and be it further

 

RESOLVED, that this resolution will take effect immediately.
