LOCAL LAW AUTHORIZING THE SALE OF CITY-OWNED PROPERTY ON ROCKLAND AVENUE, ASH STREET, RIDGEVIEW AVENUE, LAWTON LANE, HERRIOT STREET AND BYRON AVENUE TO THE YONKERS INDUSTRIAL DEVELOPMENT AGENCY FOR THE PURPOSE OF DEVELOPING AFFORDABLE HOUSING.

Be it enacted by the City Council of the City of Yonkers, as follows:
Section 1. General City Law, Section 23 and Second Class Cities Law, Section 37 are hereby superseded to the extent herein, provided as follows:
The City Council of the City of Yonkers, having determined that the properties herein described are not currently being used, nor have been designated for any specific use in the future, nor can they be utilized for any intended municipal purpose and are considered surplus, hereby authorizes the Mayor to sell and convey, by private sale, the following listed properties by quitclaim deed, in a form acceptable to the Corporation Counsel, to the Yonkers Industrial Development Agency (the “Agency”) for the purpose of improving said properties as affordable housing (the “Properties”):

Section 2. It is acknowledged and agreed that the Agency contemplates a further transfer of the Properties to the Municipal Housing Authority of the City of Yonkers in accordance with this Local Law, for purposes of the development of said Properties as affordable housing. The Agency shall adhere to the below terms in connection with any land disposition agreement (“LDA”) entered into in furtherance of such transfer.
Section 3. Consideration for this sale shall be for such amount as may be determined to be the fair market value of the properties plus the cost of appraisals, as determined by a licensed New York State certified general real estate appraiser.
Section 4. The Corporation Counsel is authorized to include, in said deeds, such other terms and conditions which are in the best interest of the City of Yonkers, including to make any change or amendment deemed necessary to effectuate the purposes hereof.
Section 5. The Mayor, or his authorized designee is hereby empowered to execute all instruments and take all actions reasonable and necessary to effectuate the purposes hereof.
Section 6. This local law shall take effect as provided by law.
