A LOCAL LAW AMENDING SECTION 56-55, TITLED “EXPIRATION OF PERMIT” OF ARTICLE X OF CHAPTER 56 PART VI OF THE CODE OF THE CITY OF YONKERS AS IT RELATES TO EXCAVATION PERMITS.

 

BE IT ENACTED, by the City Council of the City of Yonkers, as follows:

Section 1.                     Recitals

 

To allow for the Department of Housing and Buildings to more effectively enforce the Yonkers Zoning Code as it relates to excavation permits to protect the safety and welfare of the residents of the City of Yonkers, the Yonkers City Council deems it necessary to enact the following amendments to section 56-55, titled “Expiration of permits” of the Yonkers Building Code.  

 

Section 2.                     Amendments

 

                                          Chapter 56 of the Code of the City of Yonkers, more commonly known as

The Building Code of the City of Yonkers, is hereby amended in part by amending §56-55 entitled “Expiration of permit”, to read as follows:

Permits for excavations, including removal of sand, gravel, rock and earth, shall expire one (l) year from the date of issuance unless extended by the Commissioner. Permits for topsoil removal shall expire 60 days from the date of issuance unless extended by the Commissioner.

 

A.                     An expiring permit may, upon written request, be renewed for a one (1) year period, at the discretion of the Commissioner, provided that:

 

(1) The permit has not been revoked, suspended or expired at the time the      application for renewal is made.

(2) All relevant information in the application is up to date.

(3) The building permit application for the associated work is in compliance with the New York Uniform Code and this Code.

(4) The renewal fee is paid.

(5) A building permit has been obtained for work on the premises associated with the excavation permit.

(6) Construction activity is underway, for which purpose the excavation permit is required.

 

B.                     The renewal fee for each expiring permit for excavation issued pursuant to this section shall be as follows:

(1)                     For excavations, including the removal of sand, gravel, rock or earth, a minimum renewal fee of $5,000 for an excavation volume not to exceed 20,000 cubic yards. For excavations exceeding 20,000 cubic yards, the minimum renewal fee shall be $5,500 plus $0.25 for each additional cubic yard or fraction thereof.

(2)                     For topsoil removal, a minimum renewal fee of $5,000 for the first 5,000 square feet. For areas exceeding 5,000 square feet, the minimum renewal fee shall be $5,500 plus $0.25 for each additional square foot or fraction thereof.

(3)                     For filling vacant land, a minimum renewal fee of $5,000 for a fill volume not exceeding 20,000 cubic yards. For fill exceeding 20,000 cubic yards, the minimum renewal fee shall be $5,500 plus $0.25 for each additional cubic yard or fraction thereof.

 

Section 3.  Effective Date and Term

 

                                          This Local Law shall take effect in accordance with law, subject to the requirements of Section C4-6.C of Article IV of the Code of the City of Yonkers, entitled Adoption of Legislation, and the City Clerk is directed to cause the publication of this ordinance in accordance with requirements stated in said section.
