RESOLUTION NO. ____ - 2026
BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MINORITY LEADER BREEN, COUNCILMEMBERS PINEDA-ISAAC, DIAZ, ROBINSON, AND HODGES.
STATE ENVIRONMENTAL QUALITY REVIEW ACT RESOLUTION
FOR VARIOUS CAPITAL PROJECTS IN AND FOR THE CITY OF YONKERS AND THE CITY OF YONKERS SCHOOL DISTRICT.
WHEREAS, there is pending before the City Council bond ordinances to authorize the issuance of bonds of the City of Yonkers (the “City”) and the City’s School District (the “District”) to the finance the projects (the “Projects”) set forth in Schedule “A” annexed hereto and forming a part hereof; and
WHEREAS, following adoption of this Resolution, City Council approval of the bond ordinances will be required in order to adopt said bond ordinances; and
WHEREAS, the City Council of the City of Yonkers has reviewed the potential environmental impacts associated with said Projects;
WHEREAS, the City’s Planning Department (“Planning”) has advised that, based on its review, the following capital project: 1) Washington Park; was previously reviewed and classified as “Unlisted” actions (the “Unlisted Projects”) under the State Environmental Quality Review Act and its implementing regulations, 6 NYCRR Part 617 (“SEQRA”) and an Environment Assessment Form (“EAF”) completed, annexed hereto as Schedule “B”, and the Council previously declared its intent to serve as lead agency (Resolution 64-2026); and
WHEREAS, the City’s Planning Department (“Planning”) has advised that the remaining projects set forth in Schedule “A”, have been reviewed and determined to either be “Type II” Actions, under SEQRA and no further environmental review is required at this time; or a full environmental review has previously been completed as an “Unlisted Action”;
NOW, THEREFORE, be it resolved by the City Council of the City of Yonkers, Westchester, State of New York, as follows:
RESOLVED, following City Council’s review, which classified Washington Park as “Unlisted” Action under SEQRA, the City Council declares itself Lead Agency and has reviewed the Environment Assessment Form (“EAF”) completed for these projects, copies of which are annexed hereto as Schedule “B”, hereby determines that there will be no significant adverse impact on the environment from these projects and therefore the City Council does not require any further environment review and the Council hereby adopts a negative declaration for the projects, and be it further
RESOLVED, following review by the City Council, it was determined that the remaining projects set forth in Schedule “A”, have been reviewed and determined to either be “Type II” Actions, under SEQRA and no further environmental review is required at this time; or a full environmental review has previously been completed as an “Unlisted Action”; and be it further
RESOLVED, that the City Council President is authorized to sign the EAF for the Washington Park project, and any other completed EAFs for projects listed on Schedule “B”, and the City Clerk is authorized and directed to execute and publish any documentation as SEQRA may require; and be it further
RESOLVED, that this Resolution shall take effect in accordance with law.
