BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS, PINEDA-ISAAC, DIAZ AND HODGES:
LOCAL LAW AUTHORIZING THE CONVEYANCE OF THE FORMER PUBLIC SCHOOL #9 FOR THE REDEVELOPMENT OF SAID PROPERTY

Be it enacted by the City Council of the City of Yonkers, as follows:
Section 1. General City Law Section 23 and Second Class Cities Law Section 37 are hereby superseded to the extent herein, provided as follows:
Naji Darwiche dba DarBuilding General Construction with a principal place of business at 255 South Broadway, Yonkers, New York 10705 (hereinafter referred to as “Purchaser”) have expressed an interest to the City of Yonkers in purchasing the former public school # 9 located at 53 Morningside Avenue, Yonkers, New York, and identified on the Official Tax Map of the City of Yonkers as Section 2, Block 2163, Lot 23 (hereinafter the “Subject Property”). The Subject Property is not currently being used, nor has it been designated for specific use in the future nor can it be utilized by the City of Yonkers for its intended municipal purpose and is thereby considered surplus; and
The City Council of the City of Yonkers hereby authorizes the Mayor to execute a contract of sale containing substantially the same terms and conditions as set forth below with purchaser for the sale and development of the Subject Property which is to be redeveloped to residential housing (the “Improvements”). The terms and conditions set forth below are hereby approved by the City Council, as the redevelopment of this property as stated hereinabove would be in the best interest of the City.
Section 2. The consideration for this sale will be Two Million, Seven Hundred and Fifty Thousand Dollars ($2,750,000.00), subject to the following express terms and conditions:
1. The Subject Property and all improvements situated thereon shall be conveyed on an “As is, Where is” basis, with no representation or amenities expressed or implied as to the condition thereof.
2. Purchaser shall deposit the sum of Twenty-Five Thousand Dollars ($25,000.00) as an initial deposit in escrow upon its execution of the contract sale.
3. Purchaser shall be required to pay all city and state transfer taxes.
4. The sale of the Subject Property shall be without any contingencies, and closing shall occur on or before November 30, 2026.
5. Redevelopment of the Subject Property shall comply with all code and zoning requirements of the City of Yonkers.
6. Purchaser may assign the contract of sale to a newly formed corporate entity controlled by Purchaser.
7. The Mayor or his authorized designee shall negotiate such other terms and
conditions which are in the best interest of the City of Yonkers.
Section 3. This local law shall take effect as provided by law.
