RESOLUTION
BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS, PINEDA-ISAAC, DIAZ AND HODGES:
RESOLUTION TO APPROVE AN AMENDMENT TO THE PLANNED URBAN REDEVELOPMENT SPECIAL USE PERMIT ON PROPERTIES KNOWN AS 40 AND 2 RIVERSIDE DRIVE, 300 ADMIRAL WAY, 85, 75, 71, 65, 55, 45, 35 AND 25 RIVERSIDE DRIVE, 100 FISHERMAN WAY, 100 ADMIRAL WAY, ALSO KNOWN AS SECTION 2, BLOCK 2620 LOTS 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12 AND 13, PURSUANT TO ARTICLE VII OF THE YONKERS ZONING CODE.

WHEREAS, in March 2017, the City Council of the City of Yonkers (the “City Council”), following Planning Board approval, approved a special use permit for the development of a Planned Urban Redevelopment (“PUR”) on the property located at 40 and 2 Riverside Drive, 300 Admiral Way, 85, 75, 71, 65, 55, 45, 35 and 25 Riverside Drive, 100 Fisherman Way, 100 Admiral Way (Block 2620, Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10,11, 12 and 13 (the “Property”), which permitted the development of a total of 1,395 residential dwelling units in seven (7) buildings (Buildings A, B, C, D, E, F and Tower) together with approximately 48,280 square feet of commercial space, approximately 1,598 parking spaces, and a number of public amenities including a public waterfront promenade and public open space (the “Project”); and
WHEREAS, in April and May 2024, the Planning Board and City Council, respectively, approved an amendment to the previously approved PUR special use permit in connection with the Project consisting of the inclusion of 59 Babcock Place (Block 2620, Lot 82) as part of the PUR for the purpose of constructing 417 at-grade parking spaces to serve the Project; and
WHEREAS, in March 2026, Extell Hudson Waterfront, LLC (“Applicant”) filed an application for an amendment to the special use permit, seeking to:
a) eliminate the 20-story Tower;
b) construct a parking structure of approximately 543 spaces;
c) construct a 35-story mixed use commercial and residential tower containing 448 dwelling units and approximately 11,788 square feet of commercial space;
d) construct a marina containing approximately 25 boat slips;
e) add a day care center, play area, and drop off area in Building F;
f) construct a pedestrian bridge over the MetroNorth railroad tracks; and.
WHEREAS, on April 8, 2026, the Planning Board, as lead agency, issued a negative declaration pursuant the State Environmental Quality Review Act (“SEQRA”); and
WHEREAS, on July 8, 2026, following a duly noticed Public Hearing on April 8, 2026, the Planning Board unanimously approved the Special Use Permit with conditions and thereafter forwarded a copy of the hearing transcript and its Approval Resolution, including its findings to the City Council; and
WHEREAS, upon review of the current application, the proposed amendment and the record before it, this City Council believes it to be in the best interest of the City to approve the action taken by the Planning Board and grant said application.
NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby accepts the recommendation of the Planning Board that the proposed amendments to the special use permit be granted; and
BE IT FURTHER RESOLVED, that based upon the record and findings of Planning Board, the decision and actions of the Planning Board are hereby approved, and this approval is subject to any conditions set forth in the Planning Board Approval resolution; and
BE IT FURTHER RESOLVED, that all of the conclusions, findings and conditions contained in the July 8, 2026 resolution of the Yonkers Planning Board are hereby incorporated by reference and made a part hereof; and
BE IT FURTHER RESOLVED, that the Resolution shall take effect immediately.
