BY COUNCIL PRESIDENT COLLINS-BELLAMY, MAJORITY LEADER RUBBO, MAJORITY WHIP NORMAN, MINORITY LEADER BREEN, COUNCILMEMBERS PINEDA-ISAAC, DIAZ, AND MERANTE:

RESOLUTION RENEWING AND EXTENDING THE USE OF THE ERUV DISTRICT FOR NORTHEAST YONKERS JEWISH CENTER

WHEREAS, Jewish law forbids carrying on the Sabbath, except when done within an enclosed area; and

                     WHEREAS, in the furtherance of the Jewish religious tradition, in order to enable increased observance of the Sabbath, the Jewish Community practicing at the Northeast Yonkers Jewish Center has requested the establishment of an Eruv, a ritual neighborhood enclosure; and

                     WHEREAS, an Eruv District is symbolic in nature and does not contravene any federal, state or local law, it will not violate existing property rights, and it will not otherwise impair the City’s right of way or violate its Zoning Code; and

                     WHEREAS, Eruv District have been used for over 2,500 years by countless communities, and Eruvs exist today in hundreds of cities throughout the world, including the Cities of Yonkers; and

                     WHEREAS, by Resolution Nos. 103-2016 and 40-2021, the City Council of the City of Yonkers granted the Northeast Yonkers Jewish Center an Eruv District; and

                     WHEREAS, the Northeast Yonkers Jewish Center has approached the City requesting an extension of its Eruv District under the same boundaries and conditions as previously approved; and

                     WHEREAS, the Council of the City of Yonkers has determined that it is appropriate to grant such request and the Eruv rights requested, and likewise deems that it be of no public detriment to the rights and general welfare of the citizens of Yonkers; and

                     NOW, THEREFORE BE IT RESOLVED, that the City Council hereby renews and extends its proclamation of the Eruv District within the City of Yonkers, as noted on the attached map, under the same conditions as previously granted; and be it further

                     RESOLVED, that the Mayor and the City Council hereby grant to the North East Jewish Center the rights requested in order to define the Sabbath bounds in accordance with Jewish religion and Torah law at a license fee of One Dollar ($1.00) in hand paid, which license shall be for a period of for a period of seven (7) years. The rights granted herein shall not prohibit the City of Yonkers from further exercising its rights within any right of way, nor shall the rights granted herein prevent any utility from moving, burying or modifying any poles, structures, or appurtenances affecting the Eruv.

                     RESOLVED, that this Resolution shall take effect immediately.
