A RESOLUTION ISSUING A DETERMINATION OF SIGNIFICANCE PURSUANT TO THE NEW YORK STATE ENVIRONMENTAL QUALITY REVIEW ACT FOR THE PROPOSED SALE OF CITY_OWNED PROPERTY KNOWN AS 101 WOODLAND AVENUE

WHEREAS, there is pending before the City Council of the City of Yonkers (the “City Council”), a proposed local law authorizing the sale of property owned by the City of Yonkers (the “City”) located in the State of New York, County of Westchester, and City of Yonkers known as 101 Woodland Avenue and designated on the Official Tax Map of the City as Section 2, Block 2421, Lot 24.25, (the “Property”); and

WHEREAS, pursuant to Article 8 of the New York Environmental Conservation Law, as amended, and the regulations promulgated pursuant thereto by the Department of Environmental Conservation of the State of New York, as amended (collectively, "SEQRA"), the City Council must review the proposed action, which consists of the sale of the Property (the “Proposed Action”) in accordance with SEQRA; and

WHEREAS, the City Council has determined that the Proposed Action is classified as an Unlisted Action, as defined by SEQRA; and

WHEREAS, the City Council  has carefully reviewed and considered the Proposed Action, the documentation related to the Proposed Action, including the Environmental Assessment Form  (“EAF”), and the criteria set forth in Section 617.7 of 6 NYCRR Part 617 under SEQRA  and has identified and carefully considered the relevant areas of environmental concern, as more fully set forth in the EAF, to determine whether the proposed action will have a significant adverse impact on the environment.

NOW, THEREFORE, BE IS RESOLVED by the City Council, that based upon the City Council’s review of the EAF and for the reasons set forth therein, the City Council hereby adopts a Negative Declaration under SEQRA, finding that the adoption of the local law authorizing the Proposed Action will have no significant adverse environmental impacts; and be it further

RESOLVED, that this resolution shall take effect immediately.
