RESOLUTION REQUESTING PREPARATION BY THE NEW YORK STATE LEGISLATURE OF LEGISLATION AUTHORIZING THE ALIENATION OF CERTAIN PARKLAND WITHIN UNTERMYER PARK AND GARDENS

WHEREAS, the City of Yonkers (the “City”) hereby requests that the New York State Legislature prepare legislation authorizing the alienation of certain parkland within and composing Untermyer Park and Gardens consisting of a certain portion of the tax lot designated the Official Tax Map of the City of Yonkers as Section 3, Block 3535, Lot 56 measuring 10,535 square feet, which is identified as Parcel 2 and described more fully on the survey and legal description annexed hereto as Appendix A - Survey and incorporated herein by reference (the “Alienated Parcel”); and
WHEREAS, on April 14, 2025 the Parks, Recreation and Conservation Board of the City of Yonkers adopted a resolution titled Resolution of the Parks Board under the Direction of the Department Parks, Recreation and Conservation Recommending the Approval of a Land Swap Contract for Property Located at 945 North Broadway, a copy of which is annexed hereto as Appendix B - Parks Board Resolution and incorporated herein by reference; and
WHEREAS, it is anticipated that the alienation of the Alienated Parcel and its replacement with another parcel contiguous with Untermyer Park and Gardens will facilitate and result in the more effective use of surrounding properties and the expansion and enhancement of Untermyer Park and Gardens.
NOW, THEREFORE, BE IT RESOLVED, that the Yonkers City Council respectfully requests the preparation of legislation by the New York State Legislation authorizing, among other things, the alienation of the Alienated Parcel; and
BE IT FURTHER RESOLVED, that once the State parkland alienation legislation is drafted, upon the adoption by the City Council of the City, a Municipal Home Rule Request will be sent formally requesting the enactment of the parkland alienation bill, which is required for the alienation bill to be voted upon by the State; and
BE IT FURTHER RESOLVED, that the City Council hereby directs the City Clerk transmit a certified copy of this resolution to the Majority Leader of the New York State Senate, the Speaker of the New York State Assembly, and the City of Yonkers’ State Delegation requesting the preparation of the foregoing alienation legislation; and
BE IT FURTHER RESOLVED, that this Resolution shall take effect immediately.
