RESOLUTION APPROVING AN INTER-MUNICIPAL AGREEMENT BETWEEN THE CITY OF YONKERS AND THE COUNTY OF WESTCHESTER RELATED TO THE CREATION OF THE NEW CITY PARK ON THE WATERFRONT AT FERNBROOK STREET.

WHEREAS, the County of Westchester (County) and the City of Yonkers wish to enter into an inter-municipal agreement (IMA), pursuant to Sections 244-b and 119-o of the General Municipal Law, whereby the County will assist the City in constructing a new waterfront park located along Fernbrook Street in the City of Yonkers; and
WHEREAS, the County shall provide to the City an amount not to exceed $15,000,000 for the creation of the new park as set forth in the IMA; and
WHEREAS, in addition to providing funding, the County shall also convey to the City, subject to the County's easement, additional property for the park adjacent to the County's water treatment plant as set forth and more fully described in the IMA.
NOW, THEREFORE, BE IT RESOLVED, that the IMA between the City and the County for the construction of a new City park is hereby approved; and be it further;
RESOLVED, that the City accepts the conveyance of property from the County, subject to the County's easement, and in accordance with the IMA; and be it further
RESOLVED, that a review of the proposed park project pursuant to the State Environmental Quality Review Act ("SEQRA") and its implementing regulations, 6 NYCRR Part 617, was conducted and a negative declaration was issued thereto; and be it further
RESOLVED, that the Office of the Corporation Counsel for the City of Yonkers may negotiate such other terms and conditions and make such amendments to the IMA as are in the best interest of the City and necessary and appropriate to effectuate the purposes hereof, so long as any such terms or modifications do not constitut...
