RESOLUTION AUTHORIZING CITY OF YONKERS TO SEEK REVIEW OF FISCAL YEAR 2025 NEW YORK CITY WATER RATES BY THE NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION

WHEREAS, the City of New York (NYC) sets the rate for the water consumed by the City of Yonkers originating from the NYC water system; and
WHEREAS, the City of Yonkers has appeals pending before the New York State Department of Environmental Conservation (NYSDEC) of the excess and entitlement rates set by NYC for the fiscal years 2015-2024; and
WHEREAS, NYC has increased the water rate for fiscal year 2025 as follows: 8% for entitlement water and 8.5% for excess water; and
WHEREAS, the NYSDEC will review the water rates imposed by NYC if requested to do so;
NOW, THEREFORE, BE IT RESOLVED, that the City of Yonkers hereby authorizes the continued review of the water rates for FYs 2015 through 2024 by the NYSDEC; and be it further
RESOLVED, that the City of Yonkers hereby authorizes the review of the excess and entitlement water rates for the FY 2025 by the NYSDEC; and
RESOLVED, that Mayor or his authorized designee is hereby empowered to execute all instruments and take all actions reasonable and necessary to effectuate the purposes hereof; and be it further
RESOLVED, that this resolution will take effect immediately.
