SPECIAL ORDINANCE DISCONTINUING CERTAIN PORTIONS OF PUBLIC STREETS LOCATED WITHIN THE CITY OF YONKERS KNOWN AS YERKS PLACE AND PIER STREET

The City Council of the City of Yonkers hereby ordains and enacts the following:
Section 1. Pursuant to section 101 of the New York Second Class Cities Law and section 29 of the New York General City Law and in accordance with the recommendation of the Planning Board of the City of Yonkers (the “Planning Board), the certain portions of the public streets located within the City of Yonkers (the “City”) known as Yerks Place and Pier Street identified on the map and description filed with the Planning Board and included herewith as Appendix A - Yerks Place and Pier Street Discontinuance be and are hereby discontinued as a public streets and removed from the Official Map of the City, subject to the following conditions:
(1) the reservation any required easements, if any, including but not limited to easements providing for full and complete access for future maintenance or repair of existing utilities; and
(2) the conditions set forth in the recommendation of the Planning Board; and
(3) any further conditions that are in the best interests of the City.
Section 2. The appropriate City departments, bureaus, and agencies shall amend City records, including the Official Map of the City, accordingly.
Section 3. This special ordinance shall take effect as provided by law.
