title
A RESOLUTION TO ISSUE A REVISED DETERMINATION OF SIGNIFICANCE PURSUANT TO THE STATE ENVIRONMENTAL QUALITY REVIEW ACT (“SEQRA”) RELATING TO WATER SYSTEM IMPROVEMENTS
body
WHEREAS, pursuant to Resolution 135-2020, the City Council determined that certain water system improvements to the Wendover Water Main, including replacement of approximately 300 linear feet of an existing 30-inch water main that crosses below the Saw Mill River Parkway(Parkway), from Wendover Road to Tibbetts Brook Park, was an unlisted action under the State Environmental Quality Review Act (“SEQRA”) requiring the City Council to comply with the Regulations promulgated pursuant to SEQRA; and
WHEREAS, the City Council was the lead agency under SEQRA and based on its review of the Environmental Assessment Form, adopted a Negative Declaration, under SEQRA, finding that there will be no adverse impact on the environment from acquisition of the Land;
WHEREAS, the City is receiving New York State grant funding for a portion of this work and New York State classifies all projects of this sort as Type 1 under SEQRA;
NOW, THEREFORE, BE IT RESOLVED, that the City re-classifies this action as Type 1; and
BE IT FURTHER RESOLVED, that based upon the City Council’s review of the Environmental Assessment Form, and for the reasons set forth therein, the City Council re-asserts its finding that that there will be no adverse impact on the environment from acquisition of the Land and confirms its adoption of a negative declaration.
